What is Civil Mediation?

Civil Mediation is an alternative dispute resolution method, that encourages both parties to work collectively to find a solution.

Mediation allows parties to resolve matters quickly, cost-effectively and without the additional stress that is typically involved in traditional court proceedings.

We provide mediation services on a variety of matters including:

  • Breach of 01253-contract or contractual disputes.
  • Company disputes including director and shareholder disputes.
  • Construction disputes.
  • Defamation of character.
  • Disputes over money.
  • Land, boundary or property disputes.
  • Landlord, tenant or housing disputes.
  • Neighbour disputes.
  • Professional negligence – poor work carried out by builders, surveyors or other professionals.
  • Unfair dismissal or employment disputes.
  • Wills, trusts or probate disputes.

We always aim to end a dispute as quickly as it arises, which is why it is important to seek legal advice as soon as possible, to prevent the matter from escalating.

Professional Negligence

If you have found yourself suffering in any way due to the advice of a professional, you may have a Professional Negligence claim against the professional.

A professional has a duty of care to provide competent advice to their clients. This duty is breached if inadequate or incorrect advice leads directly to a client’s loss.

Most professionals have indemnity insurance, and with indemnity insurers involved, the issues can be become more complex, leading to further pressure on the parties both in terms of costs and time.

Civil Mediation allows clients an opportunity to manage such disputes sensitively, confidentially and quickly.

Construction Disputes

Construction projects can take years to complete, as they often involve layers of contractors and subcontractors.

Due to the complexities involved within the industry, construction disputes are not uncommon.

An efficient dispute resolution process should be put in place so that relationships between parties working on a project can be maintained.

We can assist by helping to minimise a dispute before it escalates, so that you can carry on and complete your project with minimal delay or disruption.

What happens during Civil Mediation?

During the mediation process we will meet with both parties independently and if appropriate, together. The purpose is to identify clearly what is the cause of the dispute and to explore all possible solutions.

Parties will then be able to exchange settlement proposals and negotiate towards an amicable agreement.

Civil Mediation is also private, so any matters discussed in meetings will remain confidential.

Our Fees

Where possible we will offer a fixed fee, so you will know what the costs are from the start. For more complex or uncertain projects, we will provide you with an estimate of the likely fees involved and keep you updated throughout the matter.
